Welcome to Ohma!

These Terms of Service, hereinafter referred to as the "Terms," are formulated by Playbyte Technology Limited hereinafter referred to as "Ohma," "we," "us," "our," or the "Platform," to govern your rights and obligations when you access, register for, log in to, or use the Ohma application, hereinafter referred to as the "App" or the "Services."

Before using Ohma, please carefully read and fully understand all provisions of these Terms. By registering for, logging in to, accessing, or using Ohma, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the relevant platform rules.

If you do not agree to any part of these Terms, please immediately stop registering for, logging in to, or using Ohma.

1. Eligibility

Ohma is only available to users who are 18 years of age or older. Users under the age of 18 are not allowed to register for, log in to, or use Ohma.

You confirm that you have reached the minimum age required by the applicable laws of your country or region and that you have the legal capacity to enter into and perform these Terms.

If Ohma discovers that a user does not meet the age requirement, has falsified age information, impersonated another person, or attempted to bypass age restrictions, the Platform has the right to restrict, suspend, or permanently terminate the relevant account and may take further measures in accordance with applicable laws or regulatory requirements.

2. Account Registration and Security

2.1 Account Registration

You may register for or log in to Ohma through your mobile phone number, Facebook Login, Google Login, Apple Login, or other login methods made available by the Platform.

You shall provide true, accurate, and complete registration information and update such information in a timely manner if it changes. You shall be solely responsible for any issues, losses, or liabilities arising from false, inaccurate, incomplete, or outdated information provided by you.

2.2 Account Security

You are responsible for properly safeguarding your account, password, verification codes, and other login credentials, and you shall be responsible for all activities that occur under your account.

Without the Platform's permission, you may not transfer, rent, lend, sell, or share your account. You may not use another person's account, impersonate another person, or register an account using false identity information or other improper methods.

If you discover abnormal login activity, unauthorized use, password leakage, or any other security risk related to your account, please contact us immediately through the methods provided by the Platform. After verifying the relevant situation, the Platform will take necessary security measures based on the actual circumstances.

2.3 Account License

An Ohma account is licensed only to the registered user for personal use. The ownership of the account and related platform data, virtual asset records, level benefits, system records, and other account-related data belongs to Ohma or the relevant rights holders. Users only receive a limited, revocable, non-transferable license to use the account.

3. Virtual Items and Recharge Services

3.1 Description of Virtual Items

Ohma may provide users with Coins, gifts, badges, decorations, VIP, SVIP, event items, and other virtual benefits.

The above virtual items may only be used within the Ohma Platform in accordance with platform rules. They have no real-world monetary value, cannot be exchanged for cash, and may not be traded, transferred, pledged, or monetized outside the Platform in any form.

3.2 Recharge and Payment

Users may purchase virtual items or related services through the payment methods supported by the Platform. You confirm that all recharge activities are based on your voluntary choice. You shall ensure that the payment method you use is lawful and valid, and that you have the legal right to use the relevant payment account.

You may not obtain, use, or transfer virtual assets through fraud, stolen payment methods, malicious refunds, exploitation of system vulnerabilities, illegal transactions, or any other improper means.

3.3 Refund Policy

Unless otherwise required by applicable laws, payment platform rules, app store rules, or local regulatory requirements, all recharge transactions and virtual item transactions are final. Virtual goods, virtual benefits, and services that have been consumed or issued are generally non-refundable and non-exchangeable.

If the Platform detects abnormal recharge activity, fraudulent transactions, malicious refunds, stolen payment methods, illegal transactions, or other risk-related behavior, Ohma has the right to restrict the relevant account, freeze or deduct abnormal virtual assets, suspend related services, and take further measures depending on the circumstances.

3.4 Platform Adjustment Rights

Ohma has the right to adjust the prices, benefits, usage rules, event rules, distribution methods, and display methods of virtual items based on product operations, event arrangements, compliance requirements, or business adjustments. Relevant adjustments will be displayed or notified within the Platform in an appropriate manner.

4. User-Generated Content (UGC)

4.1 Content Ownership

You retain the lawful rights you have in the content that you publish, upload, send, or display on Ohma. Such content includes but is not limited to text, images, voice, posts, comments, videos, nicknames, avatars, profile information, and other user-generated content.

You shall ensure that you have lawful rights to the content you publish and that such content does not infringe upon any third party's intellectual property rights, portrait rights, privacy rights, reputation rights, or other legitimate rights and interests.

4.2 Content License

When you publish, upload, or display content on Ohma, you grant Ohma a worldwide, non-exclusive, sublicensable, royalty-free license to use such content for the purposes of storing, displaying, distributing, recommending, reviewing, optimizing, promoting, and providing the Ohma Services.

The Platform will use your content only to the extent necessary for providing, maintaining, operating, promoting, and improving the Ohma Services.

4.3 Prohibited Content

You may not publish, transmit, upload, share, or otherwise display on Ohma any illegal, non-compliant, inappropriate, or rights-infringing content, including but not limited to:

If the Platform discovers any of the above content, it has the right to take measures based on the severity of the violation, including but not limited to deleting content, restricting functions, reducing exposure, banning accounts, banning devices, and reporting to relevant authorities.

5. Child Safety Policy

Ohma adopts a zero-tolerance policy toward any conduct involving abuse, exploitation, sexualization, inducement, harm, or endangerment of minors.

Ohma does not allow users under the age of 18 to register for, log in to, or use the Platform. To maintain platform safety, Ohma may use automated systems, AI review technologies, keyword detection, user reports, and manual review mechanisms to identify and handle content, behavior, and accounts involving risks to minors.

5.1 Strict Prohibition of Sexualization and Exploitation of Minors

The Platform strictly prohibits any conduct involving sexual exploitation, sexual abuse, sexual suggestions, sexualized display, pedophilic tendencies, inducement of minors to participate in sexual conduct, or display of nudity or sexualized content involving minors.

The prohibited content includes real content, fictional content, drawings, animations, synthetic content, AI-generated content, and any other form of expression.

5.2 Strict Prohibition of Conduct Endangering Minors

The Platform strictly prohibits threatening, harming, inducing, coercing, manipulating, or harassing minors. It also strictly prohibits promoting, encouraging, or disseminating any behavior that endangers the physical or mental safety of minors, as well as any conduct involving trafficking, abuse, exploitation, or illegal contact with minors.

5.3 Platform Restrictions Regarding Minors

Minors may not appear in Ohma's live broadcasts, voice interactions, videos, room interactions, or any other user interaction content. Users may not impersonate minors, falsify age information, or create, manage, or use accounts on behalf of minors.

For content or conduct that violates the Child Safety Policy, Ohma has the right to immediately delete relevant content, restrict or terminate accounts, permanently ban accounts or devices, and report to relevant authorities in accordance with applicable laws.

6. Content Moderation and Platform Governance

Ohma values platform content safety and community order. The Platform may use automated moderation systems, AI content recognition technologies, keyword detection, risk models, manual review mechanisms, and user reporting mechanisms to detect and handle user content, interaction behavior, account risks, and abnormal platform activities.

For content or accounts reported by users, Ohma will review the report as soon as possible after receiving it. Reports involving child safety, pornography, violence, fraud, harassment, hate speech, illegal or criminal activities, or other high-risk content will be prioritized, and the Platform will make reasonable efforts to complete an initial review or take necessary measures within 24 hours.

For conduct that violates platform rules, Ohma has the right to take measures based on the severity of the violation, including but not limited to deleting content, restricting functions, reducing exposure, temporarily banning accounts, permanently terminating services, banning devices, restricting recharge or withdrawal-related functions, and reporting to relevant authorities.

For serious illegal conduct, major security risks, child safety risks, fraud risks, or situations that may cause harm to users or the Platform, Ohma has the right to take immediate action without prior notice.

7. Community Rules and User Conduct

You agree to use Ohma in a lawful, reasonable, and friendly manner, and to comply with platform rules, community guidelines, and applicable laws and regulations.

You may not crack, attack, interfere with, or damage the Platform system. You may not use plug-ins, scripts, bots, cheating tools, or other automated methods to interfere with the normal operation of the Platform. You may not manipulate traffic, gifts, interactions, rankings, or the platform ecosystem. You may not harass, threaten, insult, or deceive other users. You may not collect, store, or spread other users' information without permission. You may not use the Platform for fraud, gambling, money laundering, illegal transactions, or any other illegal activities.

Users shall be fully responsible for their own speech, behavior, transactions, interactions, and any consequences arising therefrom, both on and off the Platform.

8. User Interaction and Risk Disclaimer

Ohma is a voice-based social and interactive entertainment platform. During your use of the Platform, you may engage in voice chats, text communication, gift interactions, event participation, room interactions, or other forms of social interaction with other users.

You understand and agree that interactions between users involve uncertainty. You should independently judge the authenticity and safety of other users' information, statements, promises, invitations, or transaction requests, and you shall bear the risks arising from your interactions with other users.

Ohma does not encourage or intervene in private transactions, private transfers, offline meetings, lending, proxy recharges, account trading, gift rebate promises, or any other off-platform conduct between users. Any disputes, losses, injuries, fraud, or other risks arising from private contact, offline meetings, private transactions, or off-platform communication between users shall be borne by the relevant users themselves, and Ohma shall not be liable.

If you discover that another user is involved in fraud, harassment, inducement of transactions, threats, infringement, or other violations, please report it promptly through the in-app reporting function or contact us through our official email address.

9. Service Changes, Suspension, and Termination

Ohma has the right to modify, suspend, restrict, or discontinue certain functions or services based on product operations, technical maintenance, compliance requirements, business adjustments, or security management needs.

Subject to applicable laws, regulations, and platform rules, Ohma has the right to restrict, ban, or terminate accounts that violate rules. For accounts that have not been logged in to for 180 consecutive days and have no pending transactions, disputes, or legal retention obligations, the Platform may treat such accounts as long-term inactive accounts and may adjust the account status, data retention, or related services in accordance with operational rules.

Users may also apply to delete their accounts at any time through the functions provided within the App. After account deletion, relevant data and benefits will be processed in accordance with applicable laws and regulations, the Privacy Policy, and platform rules.

10. Intellectual Property

Ohma and its related content, including but not limited to software programs, page designs, icons, user interfaces, trademarks, logos, text, technical solutions, sound effects, visual materials, product functions, and system architecture, are owned by Ohma or the relevant rights holders.

Without the written authorization of Ohma or the relevant rights holders, users may not copy, distribute, modify, adapt, translate, reverse engineer, sell, rent, display, commercially use, or otherwise use the above content.

Content published by users on the Platform may not infringe upon any third party's intellectual property rights or other legitimate rights and interests. If any infringement dispute arises from content published by a user, the user shall bear the corresponding responsibility.

11. Disclaimer

Ohma provides the Services on an "as is" and "as available" basis. The Platform will make reasonable efforts to maintain the stability, security, and availability of the Services, but it does not guarantee that the Services will be completely uninterrupted, error-free, absolutely secure, or that all content will be accurate, complete, or suitable for your specific purposes.

To the extent permitted by law, Ohma shall not be liable for service interruptions, data abnormalities, transaction failures, content loss, or other losses caused by network issues, device failures, system maintenance, third-party service abnormalities, payment channel issues, force majeure, user conduct, or other causes beyond the Platform's full control.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ohma and its affiliates shall not be liable for any indirect losses, loss of profits, data loss, business interruption, loss of business opportunities, reputational damage, or other consequential losses arising from the use of or inability to use the Platform Services.

Where applicable law does not allow the complete exclusion or limitation of certain liabilities, Ohma's liability shall be limited to the maximum extent permitted by law.

13. Data Storage and Cross-Border Transfer

To provide stable and secure services to users worldwide, Ohma's servers and related data storage facilities are located in Frankfurt, Germany.

You understand and agree that, for the purposes of account registration, login verification, voice interaction, content moderation, recharge payment, customer support, security risk control, data backup, and service optimization, your personal information, user content, device information, transaction records, and usage data may be stored, accessed, transferred, or processed outside your country or region.

Ohma will protect your personal information in accordance with applicable data protection laws and regulations by adopting measures such as encrypted transmission, access permission control, data minimization, log auditing, security assessment of partners, and contractual restrictions.

14. Updates to These Terms

Ohma has the right to update these Terms based on changes in laws and regulations, product function adjustments, business operation needs, or compliance requirements.

The updated Terms will be published within the Platform or through other reasonable methods, and will take effect from the date of publication or the effective date stated in the Terms. If you continue to use Ohma after the Terms are updated, you acknowledge that you have read, understood, and accepted the updated Terms.

If you do not agree to the updated Terms, you should immediately stop using Ohma.

15. Governing Law and Dispute Resolution

The operation and management of Ohma, as well as the formation, interpretation, performance, and dispute resolution of these Terms, shall be governed by the laws of the Hong Kong Special Administrative Region.

The above provision shall not affect any mandatory consumer protection rights that users may enjoy under the laws of their country or region.

If any dispute arises from these Terms, the use of Ohma Services, or platform functions, both parties shall first attempt to resolve the dispute through friendly negotiation. If the dispute cannot be resolved through negotiation, both parties agree to submit the dispute to a court with jurisdiction in the Hong Kong Special Administrative Region, unless otherwise required by mandatory applicable law.
